Terms of Service
Last updated: [Effective date]
1. Who we are
These Terms of Service ("Terms") govern your use of tixster.net and the Tixster ticketing platform (the "Service"), operated by Tixster Solutions LLC ("Tixster", "we", "us"). By using the Service you agree to these Terms.
2. Roles
Organizers are schools, transportation operators, venues, promoters and other businesses that use Tixster to sell tickets or passes. Buyers are people who purchase tickets or passes, including parents or guardians who buy passes for a student.
Tixster provides the technology. Each Organizer is responsible for its event, route or service, including its prices, schedules, capacity, safety, and refund policy. Tixster is not the operator of any event or transportation service.
3. Accounts and eligibility
You must be at least 18 years old to create an account or make a purchase. Passes for students must be purchased by a parent, legal guardian, or the school. You are responsible for keeping your login information secure and for all activity under your account.
4. Purchases and payments
Prices are shown in US dollars. Payments are processed by Stripe, Inc., and are subject to Stripe's terms. Tixster does not store full card numbers. Service or processing fees, if any, are shown before you complete your purchase.
5. Tickets and passes
- Each ticket or pass has a unique QR code. Single-use tickets are valid for one entry. Passes are valid for the period shown on the pass and may be scanned each time they are used.
- Tickets and passes may not be copied, resold, or transferred unless the Organizer allows it. Duplicated codes may be rejected.
- Student passes are personal to the student named on the pass.
6. Refunds and cancellations
Refunds are governed by the Organizer's refund policy, which is shown at checkout or available from the Organizer. If an event is canceled, the Organizer is responsible for any refund. [Describe Tixster fee refund policy.]
7. Organizer obligations
Organizers agree to provide accurate information, comply with applicable laws, honor tickets and passes sold through the Service, and, where they handle student information, comply with FERPA, COPPA and applicable state student privacy laws. [Organizer agreement and payout terms to be referenced here.]
8. Acceptable use
You agree not to misuse the Service, including by attempting to access data you are not authorized to see, interfering with the Service, using automated tools to buy tickets, or using the Service for unlawful purposes.
9. Intellectual property
The Tixster name, logo and software are owned by Tixster Solutions LLC. Organizers keep ownership of their own content and grant Tixster a limited license to display it to provide the Service.
10. Disclaimers and limitation of liability
The Service is provided "as is" and "as available". To the fullest extent permitted by law, Tixster is not liable for indirect, incidental, special or consequential damages, or for the acts or omissions of any Organizer. [Liability cap and disclaimers to be finalized by counsel.]
11. Dispute resolution
[Governing law, venue, and any arbitration or class action waiver provisions to be drafted by counsel.]
12. Changes
We may update these Terms. If we make material changes, we will post the new Terms on this page and update the date above.
